Lecangs LLC (“Lecangs”, “us”, “we”) is committed to protecting your Personal Information. This Privacy Notice (“Notice”) describes how Lecangs and its affiliates (collectively “Lecangs”) collect and process your Personal Information through Lecangs websites, services, software systems, and applications that refer this Notice (together “Lecangs Services”).

This Notice provides details for residents of certain U.S. states, including California, Colorado, Connecticut, Delaware, Lowa, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Texas, Utah, and Virginia, on how we collect, use, and disclose Personal Information, the rights such residents may have with respect to that Personal Information, how such residents may exercise their rights, and how we secure and retain Personal Information.

For purposes of this Notice, “Personal Information” has the same meaning given in the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (collectively, the “CCPA”) and other U.S. state-specific privacy or data protection laws.

This Notice may be modified from time to time and will be posted on this page. By accessing Lecangs Services, you acknowledge that you have agreed to our collection and processing of your Personal Information in accordance with this Notice.

Categories of Personal Information Collected, Processed, and Disclosed During the Past 12 Months

When you use the Lecangs Services, Lecangs may collect certain Personal Information about you as described in this Notice. Such Personal Information include Personal Information that you actively and voluntarily provide when accessing Lecangs Services, Personal Information provided by our contractual customers, and Personal Information that has been generated by us in connection with your use of the Lecangs Services.

We do not collect any categories of Sensitive Personal Information as defined under the CCPA and other applicable state-specific data protection laws. The following chart describes our collection, use, and disclosure of Personal Information during the past 12 months. This chart summarizes the categories of Personal Information we collect and process, the purposes for the collection and processing, and the categories of third parties to whom we may have disclosed such Personal Information.

Sales of Personal Information 

We do not and will not sell Personal Information we collect for the identified purposes.

Disclosure of Personal Information 

As indicated in the Notice, we disclose your Personal Information to third parties for identified purposes, including but not limited to marketing and other services performed on behalf of us, to protect against fraud and malicious activity, to fulfil the purpose for which you provide it, and for other business purposes as described in the Notice. We only disclose Personal Information to third parties who are bound by contractual obligation to use it only for the specified business/commercial purposes for which we disclose it to them, to comply with obligations under applicate state privacy or data protection laws, and to provide same level of privacy protection on the Personal Information.

Cookies and Other Tracking Technologies

Our site use Google Analytics to measure traffic, analyze user behavior, and improve the functionality of our site. You can change your cookie settings for this website by clicking the “Cookie Settings” link in the website footer and adjusting your preferences. Children’s Privacy

We do not intend that any portion of our Lecangs Services will be accessed or used by children under the age of 18, or equivalent minimum age in the relevant jurisdiction and such use is prohibited. Lecangs Services are designed and intended for adults. By accessing and using Lecangs Services, you represent that you are at least 18 years old, or above the equivalent minimum age in the relevant jurisdiction and understand that you must be at least 18 years old, or above the equivalent minimum age in the relevant jurisdiction in order to use Lecangs Service.

If we obtain actual knowledge that a user is under the age of 18 years old, or equivalent minimum age in the relevant jurisdiction, we will promptly delete information associated with that user. If you are a parent or guardian of a child under the age of 18, or equivalent minimum age in the relevant jurisdiction and believe he or she has disclosed Personal Information to us, please contact us immediately through the contact details as set out below. A parent or guardian of a child under the age of 18, or equivalent minimum age in the relevant jurisdiction, may review and request deletion of such child’s Personal Information as well as prohibit the use thereof.

Security

We protect your Personal Information from loss, misuse, disclosure, alteration, unavailability, unauthorized access and destruction and maintain the confidentiality of your Personal Information. This is also ensured using appropriate administrative, technical, physical, and organizational measures. We choose our security measures taking into account the costs of implementation, and the nature, scope, context, and purposes of processing, as well as the risk of varying likelihood and severity for the rights and freedoms of natural persons. We also continuously improve our security measures to ensure the effectiveness of our security controls.

Notwithstanding the above, while we use appropriate technical and organizational measures to protect the Personal Information we hold for you, we cannot guarantee the security of any information you transmit over the internet with the existing security technology.

How Long Do We Retain Your Personal Data

We only maintain the Personal Information we collect for as long as it is necessary for us to provide our products and/or services, for as long as it is required to fulfill the purposes as identified in this Notice, or as required by law.

We determine the retention period of Personal Information based primarily on the following criteria:

1. To fulfill the purposes as described in this Notice;

2. Whether you have agreed to a longer retention period;

3. Based on the needs related to the statute of limitations for litigation;

4. Whether there are other special agreements or legal regulations concerning the retention period.

Transfer of Personal Information Outside of Your Jurisdiction

To the extent that we may need to transfer personal information outside of your jurisdiction, whether to our affiliated companies or third-party service providers, we shall do so in accordance with the applicable laws. In particular, we will ensure that all transfers will be in accordance with requirements under your applicable local data protection laws by putting in place appropriate safeguards.

Currently we have data center in Japan. The law, regulation, and standard of the country in which your information is stored or processed may be different from those of the United States. You have understood that the risks under applicable data protection laws are different and we may transfer to and store your Personal Information at our overseas facilities. However, this does not change any of our commitments to safeguard your Personal Information in accordance with this Notice.

Your Privacy or Data Protection Rights

You may have certain privacy or data protection rights under the applicable state privacy or data protection laws. However, please note that these rights may not be absolute, and in certain cases,

we may decline or deny your request as permitted by applicable state privacy or data protection laws.

Right to Know / AccessThe right to request us to disclose to you (1) the categories of Personal Information that is collected, sold, or shared by us; (2) the categories of sources from which we collect it; (3) the business or commercial purposes for which we collect, sell or share it; and/or (4) the categories of third parties to whom we disclose, sell, or share it.
Right to DeleteThe right to request us to delete any Personal Information about you, subject to certain exceptions.
Right to CorrectThe right to request us to correct any inaccurate Personal Information about you.
Right to Opt Out of Sale or SharingThe right to direct us not to sell or share your Personal Information for cross-context behavioral advertising or for targeted advertising. We cannot sell or share your Personal Information after we receive your opt-out request unless you later authorize us to do so again. For information on how we process opt-out preference signals, please see the above “Share of Personal Information” section. 
Right to Opt Out of ProfilingThe right to direct us not to process your Personal Information for profiling. 
Right Against DiscriminationThe right not to be discriminated against for exercising any of the rights described in this section.

You may exercise any of these rights by submitting your request through any one of the methods identified in the “Contact Us” section. We will not discriminate against you for exercising any of these rights. Once we receive your request to know, delete, or correct your Personal Information, request to opt out of sales or sharing, or request to opt out of profiling, we may need to collect information from you to verify your identity, before providing a substantive response to the request. You may also designate an authorized agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will request evidence that the agent has valid written authority to submit requests to exercise rights on your behalf.

We will respond to your request within 45 days of receiving a verifiable request from you. Such response period may be extended for an additional 45 days when reasonably necessary and provided that a notice of the extension is provided to you within the first 45-day period. We reserve the right to deny requests in certain circumstances permitted by applicable state privacy or data protection laws, such as where we have a reasonable belief that the request is fraudulent. We will notify you with reasons for the denial. De-Identified Data Disclosure

We may use de-identified data in some instances. We either maintain such data without attempting to re-identify it or treat such data as personal information subject to applicable state privacy or data protection law.

Colorado Privacy Act Profiling Disclosure.

Lecangs does not engage in profiling consumers in furtherance of automated decisions that produce legal or similarly significant effects, as those terms are defined under the Colorado Privacy Act.
